In addition, sensitive information, which is a special category of personal information, is outlined in the Privacy Act 1988 (Cth) and includes information and opinion regarding your membership of a professional or trade association or trade union; criminal record; health information; racial or ethnic origin; political opinions; membership of a political association; religious beliefs or affiliations; philosophical beliefs; and sexual preferences or practices. In most cases, sensitive information can only be disclosed with your consent

Health Information

Under the Privacy Act 1988 (Cth), health information is defined as any information or opinion about an individual’s health or disability, their expressed wishes regarding the future provision of health services, or a health service provider that is either personal information or other personal information collected to provide or in providing a health service. In most cases, health information can only be disclosed with your consent.

How does Cross Care Group collect personal information?

The Cross Care Group offers a variety of services, and in order to provide these services, we may ask you to provide information that is pertinent to the particular service that you have requested. This may include, but is not limited to, the following: ID information such as your name, postal address, email, telephone numbers, and date of birth; other contact details or information that is publicly available; residency or citizenship status (such as, but not limited to whether you are on a visa or citizen of Australia); qualifications, certificates, accreditation, work history, resume and application forms; references; results of inquiries made of your former employers, work colleagues, professional associations, registration body or other entities; results of competency, medical tests, background checks, health questionnaires, psychological tests or personality & behavioural profiles; salary/benefit information, bank account details, tax file number, superannuation fund; driver’s license number and other licenses; information about your hobbies and interests; details of any dealings you have with us and/or our clients; information we receive about any insurance investigations, claims, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you were involved; information we receive about a workplace accident in which you were involved; and any other additional information about you which you provide to us (including through our website).

If you consent, the Cross Care Group may also collect sensitive information about you, such as your membership in a trade union, health information, and information from police checks. The decision to provide this information is entirely up to you, and it is important to note that if you choose not to provide us with particular information that has been requested, we may be unable to provide the service that you require, or may be limited in our ability to locate and place you in suitable work.

Purposes for which Cross Care Group may collect and use your personal information

Cross Care Group employs highly skilled consultants to provide permanent recruitment services, which respond to the needs of employers and applicants by helping to place the right person in the right position. We also supply temporary staffing (contractors) to a multitude of businesses in various industries (“Clients”), as well as offering services such as training, development and e-learning, assessment and certification, employee assistance programs (“EAP”), career and organisational development, business technologies, outsourcing and outplacements. The personal information that we collect from you is used to provide recruitment and contracting services, as well as to deliver the products or services that you require in our non-recruitment businesses. Specifically, we use the information we collect to match applicants and contractors to our clients’ needs.

Your personal and sensitive information may also be used for other purposes, such as: providing the services you have requested from us; your actual or potential work placement; career guidance or management; performance appraisals; assessing your ongoing performance and prospects; undergoing any tests or assessments (including medical tests and assessments); identifying your training needs; informing you of possible work opportunities, relevant candidates, or other events such as training or information sessions via direct mail/email/sms; workplace rehabilitation; managing and resolving any complaints, inquiries or investigations in which you are involved; conducting credit checks on potential or existing Clients; undertaking criminal reference checks; research, development, business systems and infrastructure testing, and other business purposes to assist us in providing our services to you; and direct marketing to you about products and services, advising you of industry news and events, promotions and competitions, reports and other information. Should you receive such communication, you will have the option to unsubscribe.

Where we collect information from
Cross Care Group gathers information in various ways, including:

From you directly when you provide it over the phone, through emails, or in documents such as an application form or resume. When you fill out a form, leave a comment, make an enquiry or complaint, fill in an order form, or subscribe to our publications, services, or marketing and events on our website. Via your nominated referees. From clients that receive services from our contracting business. By searching for publicly available information (e.g. the internet).

Information collected from visitors to our website (including via mobile access)

When you visit our website, Cross Care Group collects data about our website users as a collective, such as their location (e.g. city & country), internet browser type, language, operating system, service provider, screen resolution and whether they are a first-time or returning visitor. This data is collected anonymously and only used in the aggregate, so no personal information is collected. We use this data to improve our website and make it more user-friendly, and also to determine how best to provide our users with the best possible experience.

Disclosures

We may need to disclose your personal information to the following parties outside of Cross Care Group: Our agents, contractors (e.g. those authorized to manage our computer systems or other recruitment suppliers, if we are working on a joint recruitment project), professional advisors, consultants, and representatives. You and your referees, when making inquiries. Your financial institution and others related to your remuneration and benefits. Government agencies or others as required or authorized by law. Cross Care Group’s related companies and any companies involved in a corporate or business restructure by Cross Care Group. Potential and actual employers, clients of Cross Care Group, and trusted third parties. Cross Care Group employees and potential employers located in countries such as Australia, New Zealand, Canada, Hong Kong, China, India, Monaco, Switzerland, Philippines, Singapore, South Africa, United Kingdom, the United States, and any other countries where Cross Care Group provides services in the future, for possible work placements or to help us offer our services to you. Referees. External providers of online services such as training and inductions. Our insurers. Professional associations or registration bodies that have a legitimate reason to access your personal and sensitive information. Workers compensation bodies. Anyone with a legal entitlement to obtain the information.

Management of personal information held by Cross Care Group

The staff members at Cross Care Group have signed confidentiality agreements and gone through privacy training to ensure that they understand their obligations under the Privacy Act 1988 (Cth) to keep your information confidential and respect your rights under the Privacy Act 1988 (Cth). Cross Care Group takes any breach of privacy very seriously and will take disciplinary action, depending on the severity of the breach. A Privacy Officer has been assigned to Cross Care Group to make sure that your personal information is managed in accordance with this Privacy Policy and the relevant privacy legislation.

How does Cross Care Group store and protect your personal information?

We take the security of your information very seriously. To ensure that your personal information is secure, Cross Care Group stores it in secure computer facilities, paper-based files, and other records. We take all reasonable steps to ensure that your information is safe from misuse, interference, loss, unauthorised access, modification, or disclosure. We may need to keep records for a certain period of time due to statutory requirements, but when we consider the information is no longer needed, we securely dispose of or de-identify the records.

Anonymous/Pseudonym

If you have a general inquiry, you may choose to use a pseudonym or remain anonymous. In some cases, however, Cross Care Group may not be able to interact with you in this way, especially where the law requires us to identify a person before providing certain information. Generally, we won’t be able to accept anonymous or pseudonymous inquiries when: It is not feasible; or We are legally required or authorized by law or a court/tribunal order to interact with you directly.

Correcting or updating information held by Cross Care Group

The Cross Care Group makes every effort to guarantee that all data gathered, utilized, or revealed about you is exact, comprehensive, and up-to-date. If you think there is a mistake or something is missing, please notify our Privacy Officer, and we will collaborate with you to revise or include the information as soon as we can.

You have the right to access the information we have on you at any time, except in cases where the law permits us not to. For security reasons, you may need to submit your request in writing, and you may be charged a fee for the search and access to your information.
